Debt buyers in Jackson County, Oregon
A handful of companies file most of the collection lawsuits heard in Circuit Court in Jackson County. They are debt buyers — firms that purchase charged-off accounts from banks for pennies on the dollar and then sue in their own name. Most of their cases end in default judgments because the person sued never responds. When a defendant does respond, the buyer has to prove it owns the specific account and prove the amount — with real records.

The deadline that decides these cases
Oregon's response is a written Answer (or a motion) filed with the court clerk within 30 days after service (ORCP 7 C(2)). Filing it is how you "appear": the summons notice says it must be filed with the required filing fee and with proof that a copy was served on the plaintiff's lawyer. In the Answer you deny what you don't admit — allegations that are not denied are treated as admitted, except the amount of damages — and raise your defenses, including the statute of limitations and whether the plaintiff is the real party in interest, which are waived if they are left out.
If nothing is filed within 30 days, the plaintiff can apply for an order of default and a default judgment (ORCP 69) without proving the debt. A short written notice to the plaintiff's lawyer that you intend to appear means they must give you 10 days' notice before asking for a default (ORCP 69 B) — a safety net, not a substitute for filing. (Statute of limitations: ORS 12.080(1))

Questions people ask
- How do I find out which debt buyer is suing me in Jackson County?
- The plaintiff's name is at the top of the court papers you were served. If the plaintiff is a company you never did business with — LVNV Funding, Portfolio Recovery, Midland Credit Management, and similar names — it is a debt buyer that purchased the account, not your original creditor. - What is a debt buyer?
- A company that purchases defaulted accounts from banks and lenders, typically for a small fraction of the balance, and then collects or sues in its own name. In court, a debt buyer must prove it owns your specific account through each link in the chain of assignment, and prove the amount with admissible records.
